1. Description of the Service

Fortbyte.io is a web-based SaaS platform that allows users to upload, share, and manage files via secure links with user-defined expiration dates. The Service is intended for sharing sensitive or time-limited data.

Uploaded files are stored using third-party infrastructure and are automatically expired or deleted based on user-defined settings or our internal policies.

2. Eligibility & Accounts

• You must create an account to use the Service.
• By using the Service, you represent that you have the legal capacity to enter into this agreement.
• There is no strict age restriction at this time; however, users must be capable of forming a legally binding contract under applicable law.
• You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account.

3. Subscription Plans & Payments

Fortbyte.io offers:

• A free trial (currently 30 days)
• Pro and Business paid subscription plans

Payments and subscriptions are processed via Paddle, a third-party payment provider. We do not store your payment details. Subscription terms, billing cycles, renewals, refunds, and cancellations are subject to Paddle’s terms in addition to these Terms.

4. User Content & File Uploads

You retain ownership of all files and data you upload (”User Content”). By uploading content, you grant us a limited license to store, process, and transmit such content solely for the purpose of operating the Service.

File Review & Moderation

We reserve the right (but not the obligation) to:

• Review uploaded files
• Restrict access to files
• Remove or delete files
• Suspend or terminate accounts

If uploaded content is determined to violate these Terms or applicable laws.

5. Prohibited Uses

You agree not to upload, share, or distribute content that includes or involves:

• DMCA or copyright violations
• Illegal or unlawful content
• Malware, ransomware, spyware, or malicious code
• Hate speech or extremist content
• Explicit or pornographic material
• Harassment, abuse, or threats
• Exposure of personal or sensitive data without authorization
• Spam or mass unsolicited distribution
• Any activity that violates these Terms or applicable laws

Violation may result in immediate content removal, account suspension, or termination without notice.

6. Data Storage & Third-Party Services

The Service relies on third-party providers, including:

• AWS S3 – secure file storage
• Paddle – subscription billing and payments
• OpenAI – automated file renaming and metadata generation

We are not responsible for outages, data loss, or service disruptions caused by third-party providers, except as required by law.

7. File Expiration & Deletion

Files expire automatically based on the expiration date set by the user. Expired files may be permanently deleted and unrecoverable. We do not guarantee file recovery once expiration or deletion occurs. You are responsible for maintaining your own backups.

8. Account Suspension & Termination

We reserve the right to suspend or terminate your account at our sole discretion, including but not limited to cases involving:

• Violation of these Terms
• Illegal activity
• Abuse of the Service
• Non-payment or fraudulent payments

Upon termination, access to files and data may be permanently lost.

9. Disclaimer of Warranties

The Service is provided ”as is” and ”as available”, without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, Fortbyte.io shall not be liable for loss of data or files, indirect, incidental, or consequential damages, or loss of profits, revenue, or business opportunities. Your sole remedy is to stop using the Service.

11. Privacy

A dedicated Privacy Policy will be provided separately. Until then, we handle data in accordance with applicable laws and reasonable security practices.

12. Governing Law

These Terms are intended for worldwide use. To the extent permitted by law, disputes shall be governed by applicable international principles, with primary reference to U.S. commercial standards. The creator of the Service resides in the Philippines.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
